Washim Sessions Court Directs Police To Investigate Nawab Malik For Making Allegations against Sameer Wankhede Over Caste Certificate

Synopsis

The Washim Sessions Court directed the police officials to investigate Nawab Malik regarding the allegation he made against Sameer Wankhede about the authenticity of his caste certificate. The court said the said offence was a cognizable offence which is mandatory for the police to investigate.

The Sessions Court of Washim has directed the police officials to investigate NCP Leader Nawab Malik under the Scheduled Caste and Scheduled Tribes Act for falsely alleging that Sameer Wankhede is Muslim by birth and he had obtained the false caste certificate for securing employment.

Sanjay Wankhede, a cousin of Sameer Wankhede, had approached the Sessions Court while submitting that his brother was the Zonal Director of NCB, Mumbai and he had arrested the son-in-law of Nawab Malik. Thereafter, when his brother initiated action against Aryan Khan, Nawab Malik started leveling false allegations against Sameer Wankhede in press conferences, he had alleged. 

In the press conference, Malik alleged that Sameer Wankhede is Muslim by birth and he obtained a false certificate to secure employment. Sanjay Wankhede argued that such allegations were made because Sameer Wankhede had arrested Malik’s son-in-law and the videos were circulated in various newspapers, on YouTube, and on T.V. He also alleged that his family was targeted by Malik since Wankhede is a scheduled caste officer and he arrested Malik's son-­in-­law.

Sanjay Wankhede told the court that he had filed a complaint with the Washim Police Station, he had written to the S.P of the police station, and had also submitted the pen drive which contained the details of the press conference, however, no action was taken by the officials. He also placed on record an affidavit of the complainant along with an affidavit of the caste certificate of his brother.

The Court while directing the police officials to investigate Nawab Malik said that the allegation against the complainant and his caste certificate disclosed a cognizable offence that was necessary to be investigated by the police.

The Court said,

“On considering the documents filed on record and submissions made by learned advocate for the complainant, it is clear that initially complainant has filed complaint with Police Station, later on he approached to S.P. He has also filed his own affidavit, he has filed on record caste certificate of his father and real brother and his brothers affidavit also. No doubt, his brother has lodged complaint at Goregaon, complainant is the resident of Washim. He resides at Washim along with other family members. News items were published in paper and on T.V. also. So, he is entitled to file the complaint here also.”
