Synopsis

The Delhi Police on Tuesday filed an Action Taken Report (ATR) before a Delhi Court in a complaint filed by IRS officer Sameer Wankhede, seeking the registration of a First Information Report (FIR) against an IPS officer for alleged harassment and atrocities punishable under the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act.

The complaint alleged that IPS officer Gyaneshwar Singh harassed Wankhede, an IRS officer belonging to the Scheduled Caste community, during an inquiry conducted by him.

Additional Sessions Judge (ASJ) Devender Kumar Jangala of Patiala House Court directed the police to supply a copy of ATR to Wankhede and scheduled the matter for further hearing on March 7.

"In view of mandate of law contained in SC & ST(Prevention of Atrocities) Act, the complainant is having right to obtain the copy of the report filed on record by Addl. DCP, South West District. Accordingly, copy of the action taken report(ATR) is supplied to the complainant,"  the court ordered. 

Notably, on February 6, the court directed the Deputy Commissioner of Police, South West District, Delhi, to submit the action taken report by the next date of hearing.

“In view of submissions and material on record, issue notice to Deputy Commissioner of Police, South West District, Delhi, to file the action taken report in respect of complaint dated July 18, 2023, made to Mumbai Police, Maharashtra, received in his office vide letter dated December 6, 2023, and referred to in the emails dated December 22 and 26, 2023, of the complainant, for the next date,” the court had ordered.

Wankhede, the former Mumbai zonal director of the Narcotics Control Bureau, lodged a complaint with the Mumbai police on July 18, 2023, which was later transferred to Delhi. Despite repeated requests, the Delhi Police allegedly failed to register the FIR or take the necessary action, prompting Wankhede to approach the court.

The complaint alleged that during the inquiry, Singh humiliated Wankhede for being a member of the Scheduled Caste, threatened to ensure his job loss, and leaked details of the inquiry to media outlets, leading to a social boycott and humiliation of a Scheduled Caste family.

Furthermore, it accused Singh of torturing witnesses to provide false statements against Wankhede and maliciously communicating with other agencies to publicly humiliate him and his community. Despite multiple complaints, no action was taken against Singh, according to the complaint.
